These Terms and Conditions (“Terms”) govern your access to and use of the website operated by STL GAME ROOMS, LLC, doing business as STL Arcades (“Company,” “we,” “us,” or “our”), including any purchases made through our website (the “Site”).
By accessing our Site or purchasing products from us, you agree to be bound by these Terms. If you do not agree, you may not use our Site or services.
1. Eligibility
You must be at least 18 years old to use this Site or place an order. By using the Site, you represent that you meet this requirement.
2. Products and Services
We sell custom arcade machines, accessories, and related products. Many of our products are custom-built or made-to-order based on customer selections.
Product images, renders, and mockups are for illustrative purposes only. Final products may vary slightly in appearance, materials, or configuration.
3. Orders and Payments
- All prices are listed in U.S. dollars unless otherwise stated.
- Payment must be received in full (or as agreed upon via invoice or financing provider) before production begins.
- We reserve the right to refuse or cancel any order for any reason, including errors in pricing or availability.
If your payment method is declined, we are not responsible for delays in production or delivery.
4. Custom Orders and Final Sales
Due to the custom nature of our products:
- All custom orders are final and non-refundable once production has begun.
- Changes requested after production starts may not be possible and, if approved, may incur additional charges.
Non-custom or accessory items may be eligible for return at our discretion (see Section 6).
5. Shipping and Delivery
- Delivery timelines are estimates only and are not guaranteed.
- We are not responsible for delays caused by shipping carriers, supply chain disruptions, or force majeure events.
- Risk of loss transfers to the customer upon delivery or pickup.
Inspect your product immediately upon delivery and report any visible shipping damage within 48 hours.
6. Returns and Refunds
- Custom-built products are not eligible for returns or refunds.
- Approved non-custom returns must be unused, in original condition, and returned within 14 days of delivery.
- Return shipping costs are the responsibility of the customer unless otherwise agreed in writing.
Refunds, if approved, will be issued to the original payment method.
7. Warranties and Disclaimers
We provide a limited warranty covering manufacturing defects for a period specified at the time of purchase.
Except as expressly stated:
- Products are provided “as is” and “as available.”
- We disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
8. Limitation of Liability
To the fullest extent permitted by law:
- STL GAME ROOMS, LLC shall not be liable for any indirect, incidental, consequential, or special damages.
- Our total liability shall not exceed the amount paid by you for the product giving rise to the claim.
This includes, but is not limited to, loss of profits, loss of data, or downtime.
9. Intellectual Property
All content on the Site—including images, designs, logos, text, and software—is the property of STL GAME ROOMS, LLC or its licensors and may not be copied, reproduced, or used without written permission.
Custom artwork provided by customers remains the customer’s property; however, you grant us a license to use it solely for the purpose of fulfilling your order.
10. Acceptable Use
You agree not to:
- Use the Site for unlawful purposes
- Attempt to interfere with the Site’s operation or security
- Submit false or misleading information
We reserve the right to suspend or terminate access for violations.
11. Third-Party Services
We may integrate third-party services (e.g., financing providers, payment processors). We are not responsible for the policies, actions, or services of third parties.
12. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in that state.
13. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site. Continued use of the Site constitutes acceptance of the revised Terms.
